They contended that the employees of the Authority were not civil servants and therefore not eligible for the benefit of the Office Memorandum. They further stated that the petitioner's entitlement to allowances and benefits was subject to approval by the Board of the Authority.The court held that the writ petition was maintainable based on previous judgments. The court also noted that the petitioner, being a 'Transferee employee,' was entitled to the same pay and allowances he received in his previous department. Moreover, the Civil Aviation Authority's service regulations stated that the retirement and pensionary benefits applicable to Federal Government employees should also apply to Authority employees.
