Summary: Regularization of Service----''regularization has to besupported by legislation and is not an automatically accruingright. Even if we agree with the findings of the learned HighCourt that the Respondents have been serving efficiently formany years, it is worth noting that the fact that theRespondents were project employees has not beencontroverted. As such, Section 3 in its plain languageexcludes project employees from the benefit of regularizationunder the provisions of the 2009 Act. Therefore, keeping inview the language of the 2009 Act itself, there appears nolawful basis for the Respondents to claim beneficialinterpretation of the 2009 Act as the Court cannot overstepits powers to add language to a statute which the legislaturehas not provided. The Impugned Judgments of the learned HighCourt proceed on an incorrect factual and legal premise andhave erroneously applied the law, rules and regulations to thefacts and circumstances of the cases before it. The motive behind the attack was a dispute related to the installation of a water connection.Initially, the trial court sentenced the person responsible for the assault to 8 years of rigorous imprisonment along with a fine and compensation to the victim. Upon appeal, the High Court upheld the conviction but reduced the sentence to 4 years. The defense argued that the prosecution had not proven the case beyond a reasonable doubt and that the injuries sustained did not meet the criteria for "intention or knowledge" as required by the relevant legal section. However, the court disagreed, stating that the injuries clearly indicated the intention and knowledge of the attacker. The court emphasized that the consequences of the assault were determined by the assailant's conduct rather than the victim's endurance.Ultimately, the Supreme Court of Pakistan dismissed both criminal petitions (No. 513 of 2021 and No. 102-P of 2021). The sentences were not increased, and the High Court's judgment was upheld.
