Case No: CP No. 1866-L/1999

Judgment Date: 25-06-2002

Jurisdiction: Supreme Court of Pakistan

Judge: Justice Mian Muhammad Ajmal

Summary: (a) West Pakistan Land Revenue Act (XVII of 1967)----S. 45: Mutation of Tamleek---Validity---Challenge by co-heirs. A declaratory suit was filed by the respondents, daughters of the predecessor-in-interest, challenging Mutation No. 20 dated 3-9-1970, which transferred disputed land to their brother, Allah Bakhsh, through Tamleek. The Courts below found that the petitioner failed to produce any valid order to justify the mutation. The mutation was held to have been secured fraudulently to exclude the respondents from their legal inheritance. (b) Specific Relief Act (I of 1877)----S. 42: Suit for declaration---Inheritance rights of female heirs---Fraudulent exclusion by male co-heir. The respondents were co-sharers and entitled to their share of the inherited property. Evidence revealed that the petitioner illegally obtained the mutation to deprive his sisters of their inheritance rights. The Civil Judge and the District Judge decreed the suit in favor of the respondents, holding the mutation to be void. The High Court dismissed the revision petition in limine, affirming the concurrent findings of the lower courts. (c) Constitution of Pakistan (1973)----Art. 185(3): Supreme Court's refusal to grant leave---Concurrent findings of fact. The Supreme Court found no illegality or misreading of evidence in the concurrent findings of the lower courts. The petitioner’s claim was dismissed as devoid of merit, and leave to appeal was refused. ----Disposition: Petition dismissed. Leave to appeal refused.
