Summary: The petitioner seeks post arrest bail and the allegation against him is that he raised Lalkara and thereafter made fire, which hit the son of the complaint on the abdomen and crossed from his back. The petitioner is directly charged in the promptly lodged FIR and the delay in conclusion of the trial had occasioned on account any act or omission of the accused or any one acting on his behalf as provided in the 3rd proviso of Section of section 497(1) Cr.P.C and the ground of delay in conclusion of the trial is not available to the petitioner as the request for adjournment was made by defence side.
