The State and another (PLD 2017 S.C 733), which established that bail should generally be granted for offenses not covered by the prohibitory clause of Section 497 Cr.P.C.The Court emphasized that Section 489-F of the PPC was intended to determine criminal guilt, not to recover alleged amounts. It stressed the importance of a fair trial and noted that granting bail at this stage would not prejudice the trial's outcome. The Court found that the petitioner's case fell within the ambit of Section 497(2) Cr.P.C., which allows further inquiry into the petitioner's guilt.Consequently, the petition was converted into an appeal, and the Court allowed the appeal, setting aside the Peshawar High Court's order.
