The trial court initially protected the petitioner's possession but restricted any further improvements on the land. However, the appellate court and revisional court set aside the protection of possession, directing the District Collector to vacate the property under the Natore Rules. (c) Administration of Justice: ---Remand of cases---When a trial court fails to resolve or settle framed issues on the basis of evidence and material on record, higher courts have the authority to remand the case for fresh adjudication. The remand aims to ensure a fair trial and adjudication based on merit without being influenced by prior observations of the trial, appellate, or revisional courts. ----Disposition: The case was remanded to the trial court for fresh adjudication within three (3) months, with directions to decide the matter on its own merits without being influenced by prior observations of the courts. The status quo is to be maintained until the trial court takes cognizance.
