One Na Baig non-muslim ticket holder of Pakistan Tehreek-e-Insaf filed election petition before the learned Election Tribunal Chitral which petition was allowed and was declared returned candidate for above discussed vacant seat being next in number and was notified on 29.10.2026 as returned candidate. Present petitioner challenged the judgment of Election Tribunal dated 12.09.2015 on the ground that seat fell to JUI(F) and he is ticket holder of the JUI(F) and be declared as returned candidate under Rule.41 Sub rule 4 of Khyber Pakhtunkhwa Local Council conduct of Elections rules 2014. Petitioner filed his nomination papers on 22.07.2015 much after prescribed date of filing nomination papers w.e.f13.04.2015 to 17.04.2015 thus accepting his nomination papers after prescribed date and declaring him as returned candidate by Returning officer was order without lawful authority, void ab-initio and against relevant elections rules. Writ petition dismissed.
