Judgment Date: 08/07/2014

Judge: Justice Faisal Zaman Khan

Summary: The case revolved around the appointment of a Lumberdar in Village Tibbi Mehtab Singh, Tehsil Chunian, District Kasur. After the demise of Qadir Bakhsh, the father of Muhammad Ali (respondent No.1), who was the previous Lumberdar, Muhammad Ali was appointed as the permanent Lumberdar in 1986. The petitioner, Muhammad Hanif, filed an application before the Tehsildar, claiming that Muhammad Ali had been absent from the village for 14 to 15 years and, therefore, was not entitled to retain the post of Lumberdar. Hanif sought to be appointed as Lumberdar in Muhammad Ali's place.Following an inquiry and reports from revenue functionaries, the District Officer (Revenue)/District Collector, Kasur (DOR) held that Muhammad Ali was not entitled to retain the Lumberdar post due to his absence from the village. Subsequently, Muhammad Hanif was appointed as the Lumberdar on 22nd July 2006. In response, Muhammad Ali appealed to the Executive District Officer (Revenue), Kasur, who overturned the DOR's decision and allowed Muhammad Ali to retain the Lumberdar position.Unsatisfied with the decision, Muhammad Hanif filed a revision petition to the Board of Revenue, which was dismissed. As a result, he brought this writ petition to challenge the decisions of the authorities and seek a reexamination of the case. The Lahore High Court reviewed the case and found that both the DOR and the Board of Revenue had not adequately considered the evidence and allegations presented by Muhammad Hanif. The court also noted that the appointment of Hanif as Lumberdar had bypassed the proper procedure, which lacked transparency. The court, therefore, set aside the previous orders and remanded the case to the Executive District Officer (Revenue), Kasur, to reconsider the appeal of Muhammad Ali while considering all necessary evidence from both parties. Additionally, the court ordered that the revenue functionaries should follow the proper procedure for the appointment of a new Lumberdar since Hanif's appointment was deemed improper.
